Illinois man faces felony charge for alleged assault

A man accused of attacking his wife with a stun gun is in police custody according to local sources. The Illinois man is up on a felony charge after police say he was found in possession of the weapon he allegedly used on his wife. Police say the supposed attack was predicated on a bet.

According to the police report, the couple was watching a football game at a local bar in Mayville when the alleged incident took place. The criminal complaint filed by the wife says she bet her husband that the team she favored would win the game. If they did not, she said, he would be permitted to use a stun gun on her.

The report goes on to say the man indeed used the stun gun on his wife following the loss of the team in question. The report indicates the weapon was allegedly used three times before the woman called police at 12:40 a.m. Officers arriving on the scene concluded the man had been drinking at the time of the alleged assault, and arrested him on-site. No court date has been set in connection with this incident as of this writing.

Illinois prosecutors may face an uphill battle in seeing the man found guilty of the felony charge he faces. First, they will need to prove the attack did take place the way the woman claims, and second, they will need to ensure the wife was not complicit in the actions the accused man may or may not have taken. While consent would not negate the criminal nature of the act, it may mitigate sentencing should it be established.
