Driver charged with DUI after slamming into tree

On Behalf of | Mar 9, 2016 | Drunk Driving-DUI Charges

Authorities in an Illinois city took a motorist into custody for drunk driving after they pulled a vehicle that had a tree in its grill over on March 4. The police had reportedly been tipped off by another driver who had seen the vehicle driving down the road.

When the vehicle, a Lincoln Town Car, was pulled over, the responding officer reportedly noticed that the airbags had been deployed. It was assumed that this had happened when the car struck the tree, When the officer talked to the driver, he reported that she smelled of alcohol. She also allegedly admitted to striking the tree in a nearby town but had no memory of where the accident had taken place. After performing poorly on a field sobriety test, she was booked on DUI charges.

Drunk driving charges can have serious consequences depending on the severity of the incident and whether or not the driver has prior DUI convictions. Depending on the circumstances, the driver could face a prison sentence and have the conviction go on their permanent record, potentially making it more difficult to find employment, a place to live or even go back to school. Additionally, drivers will likely have their license suspended for a certain period of time.

A criminal law attorney can potentially provide support for someone who is facing a DUI charge. In some cases, the results of the field sobriety or other tests can be challenged. In the event that it was the defendant’s first offense, the attorney could obtain an agreement from the prosecutor that any penalty would be waived if the defendant completed alcohol counseling.
