Illinois man faces DUI charge

A man has been charged with a felony following his arrest on the evening of Feb. 20, local police have reported. The man was arrested under suspicion of DUI by Illinois police. He is currently being held in custody against a $25,000 bond.

Police reports indicate the man was observed by local sheriff's officers making unsafe lane changes around 11:30 p.m. on the night in question. The officers making the stop said they conducted a field sobriety test, which the 32-year-old driver allegedly failed. It was also reportedly determined at this time the man did not have a valid driver's license or insurance for his vehicle.

The man was arrested and taken to a local jail, where he was awaiting further proceedings as of this report. No court date has yet been set to address the felony charges, which are exacerbated by his apparent lack of license or insurance, qualifying him for enhanced charges. It is unknown whether further tests were performed to determine the man's state of alleged intoxication once he was brought to the jail.

If the man is found guilty of the DUI charge, he could face considerable legal repercussions -- particularly if it is also proven that he did not have a valid license or insurance. However, Illinois prosecutors will have to prove in court that the unspecified field sobriety tests, not known for consistent accuracy, were properly administered and came back with a positive result for intoxication. They will also have to prove the man's rights were respected throughout the arrest process, as any deviation from acceptable practices could result in certain evidence being excluded and/or the case being thrown out of court.
